Revision of the AMLA and Introduction
of a Transparency Register
Since 1 October 2026, new rules to combat money laundering and terrorist financing have applied in Switzerland. Advisers are now also subject to the Anti-Money Laundering Act. This covers anyone who professionally participates in the purchase and sale of real estate or assists in the formation, management and administration of non-operating legal entities (domiciliary companies). The same applies to the provision of a domicile or registered office address. Advisers concerned must comply with due diligence obligations and apply for membership of a self-regulatory organisation by 1 December 2026.
In addition, a non-public transparency register has been introduced. It records the beneficial owners of companies under Swiss private law and of certain foreign legal entities. Access is granted in particular to law enforcement and supervisory authorities as well as to financial intermediaries and advisers in the context of their due diligence obligations.
